Preamble
The Seller provides hosting services sold through the website https://www.alamainguere.bzh. The list and description of rooms and services offered by the Company can be consulted on the website.
Art.1 – Object
These Terms of Sale define the rights and obligations of the parties in connection with the online sale of hosting services offered by the Seller.
Art.2 – General Conditions
These General Terms and Conditions of Sale (GTC) apply to all room reservations made through the Company’s website and are an integral part of the Contract between the Buyer and the Seller.
The Seller reserves the right to modify these at any time by publishing a new version on the website. The applicable GTC are those in force on the date of payment of the reservation. These GTC can be viewed on the Company’s website at the following address: https://www.alamainguere.bzh/en/terms-of-sales/.
The Seller ensures that their acceptance is clear and unreserved at the time of booking.
The Customer declares to have read all of these General Conditions of Sale, and to accept them without restriction or reservation.
The Customer declares to be able to legally contract under French law or validly represent the natural or legal person for whom he is committing.
Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.
Art.3 – Rooms Prices
The prices of the rooms reserved on the website are indicated in Euros including VAT (all taxes included) and are precisely indicated on the descriptive pages of each room.
They are also indicated in Euros including VAT on the booking confirmation page.
The Company reserves the right to modify their prices at any time for the future.
Art.4 – Reservation process
The Customer must follow a series of steps in order to proceed with his reservation:
– Information on each room characteristics;
– Choice of room, and of options if any;
– Filling Customer’s data (name, email address, telephone, etc.);
– Acceptance of these General Conditions of Sale;
– Verification of the booked articles, and correction if needed;
– Follow-up of the payment instructions for reservation.
The Customer will then receive payment confirmation by e-mail, and then final acknowledgment of the reservation.
After validation of the reservation, the Seller commits to honor the Customer’s reservation.
For the purposes of proper reservation, the Customer commits to provide his true identification.
The rights granted hereunder are granted only to the natural person who makes the reservation (or the person holding the email address provided).
The Seller reserves the right to refuse the reservation, for example for any abnormal request, made in bad faith or for any legitimate reason.
Art.5 – Rooms characteristics
The main characteristics of the rooms and their respective prices are made available to the buyer on the company’s website.
The information is presented in French.
In accordance with French law, a summary is confirmed on the reservation validation page.
The parties agree that the photos of the rooms and common areas have no contractual value.
Art.6 – Rooms availability
The reservation will be confirmed by the Seller, after checking the availability of the chosen room, for the time of the requested stay.
In the event of unavailability of the chosen room, the Seller may offer another room with identical services to the Customer, and the Customer reserves the right to accept the proposal, or to cancel his reservation.
The Seller may offer a room change if the event the chosen room has a malfunction, or reimburse the Customer if he does not accept the change.
Art.7 – Payment
The payment of the 1st night of the stay is due upon reservation, in order to confirm it. The Customer must pay by credit card. Secure online payment is processed by the payment provider “www.stripe.com“.
Once the payment has been made by the Customer, the transaction is debited after usual bank verification.
By communicating his banking information during the sale, the Customer authorizes the Seller to debit his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the reservation is automatically canceled.
Art.8 – Cancelation conditions
The Customer may cancel his reservation by contacting the Company by email or telephone. The Customer may cancel the reservation, and request full reimbursement of all sums paid , up to the day before arrival, by contacting the Seller by email or simple letter.
Art.9 – Claims
The Buyer may submit any claim by contacting the Company by email or by simple letter.
The Seller commits to seek an appropriate amicable solution in order to resolve the complaint.
Art.10 – Applicable law
All articles in these general conditions of sale, as well as all the purchase and sale operations referred to therein, are subject to French law.
